Decision affirms free speech rights for children in public classrooms.


The full panel of the 5th U.S. Circuit Court of Appeals emphatically has decided that the Constitution's free-speech rights apply to children, too, even if they are at school, but it has not held liable officials who were responsible for a series of constitutional violations, claiming the precedent of some 40 years was vague.

The decision this week came from the appeals court in the well-known "candy cane pen" case.

In the case, school officials barred a student from handing out candy-cane pens with a Christian message to classmates at a "winter" party. The case eventually came to include several different incidents in which school officials restricted students' speech because of the Christian content.

There could be no other result, judges concluded.

"Imagine the United States of America where the First Amendment protects a minor's right to play violent video games, a person's right to hatefully protest the funerals of our heroic men and women in the military, and the right to possess portrayals depicting animal cruelty, such as videos of people crushing kittens with their shoes, but does not protect a child's right to share a pencil with another child at school merely because the pencil says the word 'Jesus,'" wrote Judge Jennifer Walker Elrod.

It's nice to know that not all judges are idiots. While we are pleased that the kids rights have been protected, we want to see the school officials disciplined.

Man ordered to surrender guns – just for blogging!

An Arizona man has filed a federal lawsuit against some of the state's top judges, claiming they're taking away his freedom of speech and right to own firearms, all because someone didn't like what he wrote on his blog.

"You can't suspend someone's constitutional rights [for blogging]," said Mike Palmer, who is bringing forth the legal action. "Everybody in America blogs or Twitters, so it's a First and Second Amendment issue."

The scenario started when Palmer, a 55-year-old Christian missionary from Phoenix, was online discussing "spiritual death" often referred to in the Bible.

But, according to the suit, a woman from Prescott, Ariz., Melody Thomas-Morgan, complained to authorities that Palmer was threatening her with "death," keeping that word in quotes in her legal filings.

Palmer explains, "It is true that the blog, 'That Woman Jezebel,' talks about spiritual life and spiritual death. ... Spiritual 'death' as in 'The wages of sin is death.' (Romans 6:23) ... It is not true that the blog ever mentions the 'death' of Miss Thomas-Morgan."

So what we have is a retard of a woman (most likely a Christian hater) who files a law suit against a blogger claiming he threatened her life? wow!

Kenton Jones, superior court judge for Yavapai County, went along with the woman's harassment complaint and ordered Palmer to surrender his guns.

"The order says that I am not allowed to possess firearms or ammunition, and directs me to turn over any weapons to the Yavapai County Sheriff's Office," Palmer told WND.

Palmer indicated he does not own any weapons at this time, but when pressed on whether he had any guns previous to the order, he said, "No comment."

"I certainly want my gun rights," he added. "There is no law in Arizona which allows the courts to suspend any constitutional right, but in this instance, my Second Amendment right. And, of course, my life's in danger now. I can't defend myself, I can't defend you. I can't defend my fellow man."

California prisoners launch second hunger strike

State prison officials say more than 4,200 inmates in eight prisons statewide are taking part in a hunger strike that began Monday, the second such effort by prisoners in recent months.

The hunger strike was initiated to protest a lack of progress inmates are seeking in how they are treated. The earlier hunger strike, which spread to prisoners being held in other states, was aimed at getting reforms in how prisoners are designated for incarceration in segregated housing units, which inmate advocates say leave inmates in isolation.

Inmate advocates? In other words they mean family members and people who advocate crime! What is an inmate? A criminal! If you advocate inmates, you advocate crime!
California prison officials are currently lining up disciplinary tactics to punish the inmates for their illegal actions.

If the inmates are segregated a certain way it's because their crime and actions have deemed it necessary to house them in such a way. Inmates (especially California inmates) are very manipulative. And this is just another way for them to try to get what they want and to beat the system.

Notify your state leaders and tell them you want tougher on crime laws, and tougher on inmate living conditions in prison systems. They already have better medical care than you or I. And they get it free! Paid for by good citizen's tax dollars.

We applaud CDCr for their efforts in keeping the public safe! And keeping the bad guys behind bars! Thank you CDCr!

Rush: Democrat 'dead serious' about suspending elections

Despite claims that she was joking, North Carolina Gov. Beverly Perdue is "dead serious" with her suggestion that the 2012 congressional elections be suspended, according to radio host Rush Limbaugh, and at least one group is now calling for the Democrat's impeachment.

"No, she wasn't joking," Limbaugh said today. "If they could get away with canceling elections, they would do it. That is who the Democrats of today are. That's what the American left is all about."

There is a scripture in the Bible that speaks of things that are good being looked as evil, and evil things being looked at as good. It states it will be like that in the end times. Iranian Pastor Faces Execution for Refusing to Recant Christian Faith

An Iranian pastor who has refused to renounce his Christian faith faces execution as early as Wednesday after his sentence was upheld by an Iranian court.

Pastor Youcef Nadarkhani, who maintains he has never been a Muslim as an adult, has Islamic ancestry and therefore must recant his faith in Jesus Christ, the 11th branch of Iran's Gilan Provincial Court ruled. Iran's Supreme Court had ordered the trial court to determine whether Nadarkhani had been a Muslim prior to converting to Christianity.

The judges, according to the American Center for Law & Justice, demanded that Nadarkhani, 34, recant his Christian faith before submission of evidence. Though the judgment runs against current Iranian and international laws and is not codified in Iranian penal code, the judge stated that the court must uphold the decision of the 27th Branch of the Supreme Court in Qom.

When asked to repent, Nadarkhani stated: "Repent means to return. What should I return to? To the blasphemy that I had before my faith in Christ?"

"To the religion of your ancestors, Islam," the judge replied, according to the American Center for Law & Justice.

"I cannot," Nadarkhani said.

(UPDATE) Teacher Placed on Administrative Leave for Punishing Christian Student

Last week, high school freshman Dakota Ary was given in-school suspension for telling another student that he believes homosexuality is wrong because of his Christian faith. Western Hills High School teacher, Kristopher Franks, is responsible for his suspension and has now been placed on administrative leave with pay. Liberty Counsel is representing Dakota in this case, demanding full vindication and a full retraction of the suspension.

Dakota was in Franks' German language class on Tuesday when the topic of homosexuality arose. Dakota said to one of his classmates, "I'm a Christian and, to me, being homosexual is wrong." Franks overheard the comment, wrote Dakota an infraction, and sent him to the principal's office. The class topic was religious beliefs in Germany. During the discussion, one student asked what Germans thought about homosexuality in relation to religion. Another student then asked to hear some translated terms such as "lesbian." These questions provoked the conversation about Christianity and Dakota's expression of his opinion to one classmate.

The discipline referral form says the comment was out of context, even though the lesson for the day was on religious beliefs. Franks charged Dakota with "possible bullying" and indicated, "It is wrong to make such a statement in public school." Two weeks prior to this event, Franks displayed a picture of two men kissing on a "World Wall" and told his students that homosexuality is becoming more prevalent in the world and that they should just accept it. Many of the students were offended by the Franks' actions and his continually bringing up the topic of homosexuality in a German language class.

After Liberty Counsel sent a demand letter to the school and then met with school officials, the school district reversed the in-school suspension and placed Franks on administrative leave with pay. We are pleased with the school's response thus far. The teacher clearly crossed the line and should apologize publically to Dakota. It is intolerable for the teacher to ridicule the religious beliefs of students in front of class. This teacher should not force his views about homosexuality upon students. Teachers cannot use their position to bully students and humiliate them in front of their peers.
