Judge rejects immediate end to prison oversight

SACRAMENTO, Calif. -- A federal judge on Wednesday rejected California's call for an immediate end to federal oversight of medical care in state prisons, ruling that the state has yet to prove that it's ready to retake control.

U.S. District Judge Thelton Henderson, of San Francisco, instead proposed a gradual transition back to state control. He set no deadline in the four-page ruling, which comes six years after he appointed a receiver to run inmate health care operations.

The transition could take at least a year, said Don Specter, director of the nonprofit Prison Law Office, which filed the lawsuit.

Henderson's order came after Gov. Jerry Brown's administration and attorneys representing inmates could not agree on ending a receivership that has cost taxpayers billions of dollars and forced a shift of lower-level criminals from state prisons to county jails.

Instead, the two sides submitted conflicting recommendations to Henderson earlier this month. Their recommendations show that the receiver "has made significant progress in improving the delivery of medical care in California's prisons," the judge wrote.

But they also reveal lingering problems over stalled construction projects and over how to measure when prisons are providing adequate health care.

Henderson concluded that while Brown's administration said it is ready to retake control of inmate medical care within 30 days, "the record does not contain sufficient evidence to support that assertion."

He ordered the federal receiver, J. Clark Kelso, to continue gradually turning over his responsibilities to the state Department of Corrections and Rehabilitation. He also told Kelso to work with court experts to decide how to evaluate medical care provided by the prisons.

Kelso's spokeswoman, Nancy Kincaid, could not estimate how long the process would take. Henderson told both sides to comment on his transition plan by July 20.

"The bottom line is he seems like he wants to ensure that no matter what happens, the care doesn't get any worse and hopefully gets better," Specter said. "How this is managed is very important because we're talking about life and death issues here."

Corrections Department spokesman Jeffrey Callison said the state still believes the receiver is no longer necessary, despite the judge's ruling. But he said officials are encouraged that the judge is ordering Kelso to continue returning health care authority to the state.

Inmates in California's state prisons are very spoiled. You would almost think the prisons were country clubs and not prisons. Inmates don't die in state prisons because of a lack of good healthcare, they die because they parole over and over and return to prison over and over and every time they come back to jail, they have been using hardcore drugs and destroyed their bodies. Most inmates come into prison very unhealthy and close to death due to their poor living styles and drugs. Then when they die, liberal judges like to cry "INADEQUATE HEALTHCARE"!!

Get a clue you bench jockeys, It's not the job or mission of state prisons to provide great healthcare even though they do. Their mission and job is to keep criminals incarcerated and off the streets all in the name of protecting the public. if they want great healthcare stay out of prison and get a job that provides that. make sense?

Obama Administration Opens the Door for Men to Enter Women’s Restrooms

The Department of Justice is requiring that the University of Arkansas at Fort Smith allow a man to use the women’s restroom. Jennifer Braley is a 38-year-old father, who has been married and divorced twice and now self-identifies as a female. The university tried to accommodate him with gender-neutral restrooms, but that was not good enough. According to a report from CampusReform.org, after Braley filed a complaint with the Civil Rights Division of the Department of Justice (DOJ), administered by Attorney General Eric Holder, the DOJ caused the university to reverse its policy and allow the anatomically male student to use the women’s restrooms.

It has never been about equality; It continues to be about changing public morals and elevating homosexual rights ahead of the privacy rights and religious liberties of others. This is just another example of the consequences of including ‘sexual orientation’ and ‘gender identity’ to the list of other protected civil rights classes, such as race, age, and disability. It is really just the tip of the iceberg. Below the surface of homosexual rights and same-sex marriage is a catastrophic ice shelf. America needs to stop and change course.

Group raises more than $70G for Texas honor student jailed for truancy

A Louisiana group has raised more than $70,000 for a 17-year-old Texas honor student jailed for missing too much school because she worked two jobs to support her siblings.

Diane Tran, an 11th-grade honor student at Willis High School near Houston, was sent to jail for 24 hours last week by Judge Lanny Moriarty and ordered to pay a $100 fine for excessive truancy.

It's unclear how many days Tran missed, but state law reportedly permits only 10 absences in a six-month period.

Tran, who works full-time at a dry-cleaning business and part-time for a wedding planner, has been supporting her brother and sister since her parents separated and her mother moved away.

Houston Councilman Al Hoang and others have roundly criticized the judge, saying he should have used some discretion in the honor student's case.

"I’m going to ask the judge to expunge the record," Hoang told FoxNews.com. "The truancy laws should be applied case by case, and in this case it should not be applied. I believe Judge Moriarty should have used his discretionary power to excuse her from this matter."

Since the girl's story went viral, hundreds of people have rallied to raise money for the teen, including one group, Louisiana Children's Education Alliance, which said Wednesday it had raised more than $70,000 for Tran.

Romney clinches GOP nomination with Texas primary win

Kansas gov. signs measure blocking Islamic law

Kansas Gov. Sam Brownback has signed a law aimed at keeping the state's courts or government agencies from basing decisions on Islamic or other foreign legal codes, and a national Muslim group's spokesman said Friday that a court challenge is likely.

The new law, taking effect July 1, doesn't specifically mention Shariah law, which broadly refers to codes within the Islamic legal system. Instead, it says courts, administrative agencies or state tribunals can't base rulings on any foreign law or legal system that would not grant the parties the same rights guaranteed by state and U.S. constitutions.

"This bill should provide protection for Kansas citizens from the application of foreign laws," said Stephen Gele, spokesman for the American Public Policy Alliance, a Michigan group promoting model legislation similar to the new Kansas law. "The bill does not read, in any way, to be discriminatory against any religion."

But supporters have worried specifically about Shariah law being applied in Kansas court cases, and the alliance says on its website that it wants to protect Americans' freedoms from "infiltration" by foreign laws and legal doctrines, "especially Islamic Shariah Law."

Brownback's office notified the state Senate of his decision Friday, but he actually signed the measure Monday. The governor's spokeswoman, Sherriene Jones-Sontag, said in a statement that the bill "makes it clear that Kansas courts will rely exclusively on the laws of our state and our nation when deciding cases and will not consider the laws of foreign jurisdictions."

Muslim groups had urged Brownback to veto the measure, arguing that it promotes discrimination. Ibrahim Hooper, a spokesman for the Washington-based Council on American-Islamic Relations, said a court challenge is likely because supporters of the measure frequently expressed concern about Shariah law.

Hooper said of Brownback, "If he claims it has nothing to do with Shariah or Islamic law or Muslims, then he wasn't paying attention."

Both the Washington-based council and the National Conference of State Legislatures say such proposals have been considered in 20 states, including Kansas. Gele said laws similar to Kansas' new statute have been enacted in Arizona, Louisiana and Tennessee.

Oklahoma voters approved a ballot initiative in 2010 that specifically mentioned Shariah law, but both a federal judge and a federal appeals court blocked it.

There are no known cases in which a Kansas judge has based a ruling on Islamic law. However, supporters of the bill have cited a pending case in Sedgwick County in which a man seeking to divorce his wife has asked for property to be divided under a marriage contract in line with Shariah law.

Supporters argue the measure simply ensures that legal decisions will protect long-cherished liberties, such as freedom of speech and religion and the right to equal treatment under the law. Gele said the measure would come into play if someone wanted to enforce a libel judgment against an American from a foreign nation without the same free speech protections.

"It is perfectly constitutional," he said.

The House approved the bill unanimously and the Senate, with broad, bipartisan support. Even some legislators who were skeptical of it believed it was broad and bland enough that it didn't represent a specific political attack on Muslims.

"This disturbing recent trend of activist judges relying upon the laws of other nations has been rejected by overwhelming bipartisan majorities in both the Kansas House and Senate," Jones-Sontag said.

The measure's chief sponsor, Rep. Peggy Mast, an Emporia Republican, also has said all Kansans, including Muslims, should be comfortable with the new law, but she did not immediately respond Friday to telephone and email messages seeking comment.

Rep. Scott Schwab, an Olathe Republican, acknowledged that the measure merely "made some people happy" and that a vote against it could be cast politically as a vote in favor of Shariah law.

"Am I really concerned that Shariah law is going to take over the Kansas courts? No," he said. "I'm more concerned about getting jobs to Kansas."

The Michigan-based alliance advocates model "American Law for American Courts" legislation. Its website says, "America has unique values of liberty which do not exist in foreign legal systems, particularly Shariah Law."

During the Kansas Senate's debate on the bill earlier this month, Sen. Susan Wagle, a Wichita Republican described a vote for the measure as a vote for women's rights, adding, "They stone women to death in countries that have Shariah law."

Hooper said supporters of such proposals have made it clear they are targeting Islamic law.

"Underlying all of this is demonizing Islam and marginalizing American Muslims," he said.

This is an important issue that needs to be dealt with. Possibly a federal constitutional amendment to stop it on all fronts and in all states. Contact your local leaders and demand it! Together we can make it happen if we fight for it.

HOLDER ORDERS WOMEN'S RESTROOMS OPEN TO MALE

On orders from Barack Obama’s Department of Justice, officials with the University of Arkansas at Fort Smith have given permission for a 38-year-old man to use the women’s restrooms on campus.

The report comes from Campus Reform.org, which explained that the individual also is seeking to have someone pay for a sex reassignment surgery to change from male to female.

Already living as a female, the individual, identified in the report as Jennifer Braly, started using women’s restrooms on campus, but quickly was the subject of complaints from women who saw him there.

The university had tried to make accommodations, designating gender-neutral restrooms in some buildings.

Not good enough, however.

Braly filed a complaint with the Civil Rights Division in the Department of Justice under Attorney General Eric Holder, school officials reported. The DOJ contacted the school.

“[T]he office of civil rights basically made its expectations through the attorney and the decision was made to respond to that direction,” said Mark Horn, the vice president of university relations. “[T]he DOJ complaint caused revisiting of our thinking.

“In the eyes of the law this individual [Braly] is entitled to use the bathroom that she identifies with,” Horn said.

The DOJ complaint was filed by Braly after the university told him to use any of the gender-neutral restrooms on campus.

“One problem to this is there are not unisex bathrooms in every building,” Braly wrote in an online essay about how other people should contribute to his surgery costs. “Especially the two main buildings where most of my classes are, so I have to go to a completely different building to use the restroom.”

While the university offered to convert other restrooms to gender-neutral, Braly said that wasn’t satisfactory.

The Campus Reform report said while anatomy matters little to the DOJ, it still remains a concern for other students.

“‘I disagree with allowing a male to use the female restrooms,” Amanda Shook, a senior at UA, told Campus Reform. “Even if they are a transgendered person, they are still a man, and should have to use the men’s restroom.”

The DOJ and school both have declined to release the letter giving the school directions on the dispute, Campus Reform reported.

The DOJ told Campus Reform that the records “pertain to a currently active Civil Rights Division enforcement and access to the records should therefore be denied pursuant to 5 U.S.C. § 552(b)(7)(A) since disclosure thereof could reasonably be expected to interfere with Civil Rights Division enforcement proceedings.”

While Braly did not respond to Campus Reform requests for comment, there is an extensive monologue by Braly on the fundraising website WePay.

That reflects that $75 has been contributed to the estimated $18,500 costs of the surgery.

Braly writes that his finances are depleted because when a second marriage ended, a custody battle “drained all my funds.”

“I am now a full-time student at the University of Arkansas Fort Smith. Most of my life is pretty normal as fitting into female society. I am passsable (sic) and have a part-time job. At the university I am running into problems all over the place.”

Braly explains that the choice to use women’s restrooms was unnoticed for a time.

“Then I took General Psychology and had asked the professor if I could give a lecture on Gender Identity Disorders for some extra credit. She not only allowed me to speak to my class but her other 2 classes as well. She also referred me to another professor and I spoke in his class too.

“I was excited I was educating people about being a transsexual and the other types of Gender Identity Disorders. Those lectures would be the beginning of all my problems. As I did get many great responses from students how my lectures greatly changed their perspective of what transsexuals are, some students were not so accepting.

“Some saw me using the womens public restrooms and complained to the university that they didn’t think I should be using the restroom with them.”

The report also complains that Braly didn’t get special accommodations in living arrangements.

“There came a problem that they would not let me room with males, and I could not room with females either unless I became friends with them and disclosed all my medical information to them…” the report continues.

“I tried to be creative and work with them on this, but to no prevail (sic),” the report said.

“Regardless of where I am at in my transtion (sic) I should have the same rights as every other female.”

Part of the reason for requesting donations for the surgery is because Braly’s income goes partly toward the monthly costs of hormone treatments as well as “required psychotherapy for transsexuals.”

Parenting, if parents trained their children up correctly this wouldn't be an issue. Training your kids from a young age to adulthood that homosexuality in any form is wrong. Changing genders is wrong. It goes against Gods will and laws.

I would advise the students at the university to not accept this under any circumstances. That's what they want you to do. They want you to accept their opinion as law and for you to shut up about it. Fight it on all fronts, legally and by protesting it. I'll do my part and advise Liberty Counsel so they may take legal action.

Secondly, pray for the troubled transgender person that they may see the light and get their life back on track. The students at the university should bring attention to the fact that girls do NOT want to use the restroom area with a male by not using the restrooms when the male is there or by not using the restrooms there ever. Make a statement.

This Obama regime is constantly inflicting wicked rules over Americans. Take a stand, vote Obama out in 2012.

Groups Concerned Over Arming Of Domestic Drones

WASHINGTON (CBSDC) – With the use of domestic drones increasing, concern has not just come up over privacy issues, but also over the potential use of lethal force by the unmanned aircraft.

Drones have been used overseas to target and kill high-level terror leaders and are also being used along the U.S.-Mexico border in the battle against illegal immigration. But now, these drones are starting to be used domestically at an increasing rate.

The Federal Aviation Administration has allowed several police departments to use drones across the U.S. They are controlled from a remote location and use infrared sensors and high-resolution cameras.

Chief Deputy Randy McDaniel of the Montgomery County Sheriff’s Office in Texas told The Daily that his department is considering using rubber bullets and tear gas on its drone.

“Those are things that law enforcement utilizes day in and day out and in certain situations it might be advantageous to have this type of system on the UAV (unmanned aerial vehicle),” McDaniel told The Daily.

The use of potential force from drones has raised the ire of the American Civil Liberties Union.

“It’s simply not appropriate to use any of force, lethal or non-lethal, on a drone,” Catherine Crump, staff attorney for the ACLU, told CBSDC.

Crump feels one of the biggest problems with the use of drones is the remote location where they are operated from.

“When the officer is on the scene, they have full access to info about what has transpired there,” Crump explained to CBSDC. “An officer at a remote location far away does not have the same level of access.”

The ACLU is also worried about potential drones malfunctioning and falling from the sky, adding that they are keeping a close eye on the use of these unmanned aircraft by police departments.

“We don’t need a situation where Americans feel there is in an invisible eye in the sky,” Jay Stanley, senior policy analyst at ACLU, told CBSDC.

Joshua Foust, fellow at the American Security Project, feels domestic drones should not be armed.

“I think from a legal perspective, there is nothing problematic about floating a drone over a city,” Foust told CBSDC. “In terms of getting armed drones, I would be very nervous about that happening right now.”

McDaniel says that his community should not be worried about the department using a drone.

“We’ve never gone into surveillance for sake of surveillance unless there is criminal activity afoot,” McDaniel told The Daily. “Just to see what you’re doing in your backyard pool — we don’t care.”

But the concern for the ACLU is just too great that an American’s constitutional rights will be trampled with the use of drones.

“The prospect of people out in public being Tased or targeted by force by flying drones where no officers is physically present on the scene,” Crump says, “raises the prospect of unconstitutional force being used on individuals.”

VOTERS PICK CREATION MUSEUM AS TOP DESTINATION

The hugely popular Creation Museum in Kentucky, which will celebrate its fifth anniversary soon, was recommended by more people than any other single location for Budget Travel’s newest list of the 15 places “every kid should see before 15.”

But it wasn’t on the list.

The list included the U.S. Space and Rocket Center in Huntsville, Ala.; the Field Museum in Chicago; SeaWorld in San Antonio; Hawaii’s Volcanoes National Park; the Birmingham Civil Rights Institute; the Abraham Lincoln Library in Springfield, Ill.; South Dakota’s Mount Rushmore; New York’s Metropolitan Museum of Art; Hoover Dam; Acadia National Park in Maine, San Francisco’s Golden Gate Bridge; Boston’s Museum of Science; Carlsbad Caverns in New Mexico; Washington’s National Museum of American History and Utah’s Arches National Park.

Heading the list was the Space and Rocket Center with 7,421 votes. The Field Museum got 839, Sea World 2,435, Volcanoes 1,260, Birmingham 750, Lincoln 3,474, Mount Rushmore 2,006, Museum of Art 204, Hoover Dam 511, Acadia 1,465, Golden Gate 525, Boston 813, Carlsbad 1,989, National Museum 271 and Arches 1,036.

The Creation Museum, which has had more than 1.5 million guests to view its Dinosaur Den, Petting Zoo and Natural Selection Exhibit, got more than 7,700.

The creation science group that runs the museum, Answers in Genesis, expressed disappointment.

The group said, “Curiously, despite being a clear winner in terms of votes received, the Creation Museum does not appear on the Budget Travel List.”

Noting the company explanation that the Creation Museum did not fit into a “universal appeal” profile, the ministry said, “We are certainly aware many evolutionists fear exposing children to the sort of critical thinking encouraged by a visit to the Creation Museum.

And while we never discourage parents from taking their children to museums such as the number two choice on Budget Travel’s list – the Field Museum of Chicago, home of ‘the biggest Tyrannosaurus rex fossil ever dug up’ – we do suggest they go armed with a bucketful of discernment.”

In response to a WND inquiry, a spokeswoman for the Budget Travel report said the company used “editorial oversight” to compile its list, “taking into account factors like geographic balance, university appeal, etc.”

“The debate around the Creation Museum showed us that it was not something everyone would agree that every kid should see, and so did not fit the ‘universal appeal’ criterion for the final editorial list. However, we know how strongly folks felt about all the places they voted for, and that’s why we call out a link to the voting page results in the introduction to the article,” the spokeswoman said.

She also said the group noted in advance it was only “using your votes” to help the company determine its list.

Yosemite National Park also got 6,347 votes but was left off the list, as was the Statue of Liberty with 3,220.

Answers in Genesis suggested that parents who take their “kids under 15″ to one of the museums be armed.

“Perhaps … some background preparation with DVDs such as Buddy Davis’s ‘A Jurassic Ark Mystery,’ Ken Ham’s DVD ‘Dinosaurs, Genesis, and the Gospel,’ Dr. Tommy Mitchell’s ‘Jurrasic Prank: A Dinosaur Tale,’ and a copy of the ‘Museum Guide’ to help sort fact from speculative fiction.”

Romney wins bragging rights over Obama

Mitt Romney's victories Tuesday in Arkansas and Kentucky may have been foregone conclusions, but besides two more batches of delegates on his way to the 1,144 he needs to clinch the Republican presidential nomination, they also gave him something else - bragging rights over usurper Obama.

In Kentucky, Romney, who is expected to clinch the nomination after the Texas primary on May 29, received a higher percentage of the vote in the Republican presidential primary than Obama received in the Democratic presidential primary. With 99.9 percent of precincts reporting, Romney had 67 percent of the vote, while Obama had 58 percent - compared to "uncommitted," which received 42 percent, according to The Associated Press.

In Arkansas, results are still in the early stages of being counted, but with 33 percent of precincts reporting, Obama has 61.5 percent of the vote, and his Democratic challenger, John Wolfe, a lawyer from Tennessee, has 38.5 percent. Romney, comparatively, has received 69.5 percent of the vote, the AP reported.

Arkansas and Kentucky are not considered competitive states in the general election; ABC News rates both states as solid Republican. Nevertheless, the strong showing by "uncommitted" and a relatively unknown candidate in his own party's primary could be viewed as an embarrassment for Obama, particularly coming on the heels of the strong performance of federal inmate Keith Judd in West Virginia's primary earlier this month.

NC teacher captured on video suggesting student could be arrested for Obama criticism


A North Carolina high school teacher was captured on video shouting at a student who questioned President Obama and suggesting he could be arrested for criticizing a sitting president.

The Salisbury Post, which first reported on the YouTube video, did not identify the teacher in question, who is reportedly on staff at North Rowan High School. The video does not show faces, but the heated argument in the classroom can clearly be heard.

"Do you realize that people were arrested for saying things bad about Bush?" the teacher said toward the end of the argument, telling the student, "you are not supposed to slander the president."

The student told the teacher that one can't be arrested "unless you threaten the president."

The argument started when the classroom began discussing news reports that Mitt Romney bullied a fellow student when he was in high school. At the time, The Washington Post had recently published a lengthy article alleging that Romney, as a teenager, had cut off another student's hair.

"Didn't Obama bully somebody though?" a student in the North Carolina classroom asked when the report was brought up, referring to an incident Obama described in his memoir "Dreams From My Father." In the book, Obama wrote that, as a child, he once pushed a female classmate after other students taunted them -- the only two black students in their grade -- and called Obama her boyfriend.

The teacher, in the video, said she didn't know whether Obama bullied anyone -- but the argument quickly escalated, as the teacher yelled at the student, telling him "there is no comparison."

"He's running for president," she said of Romney. "Obama is the president."

The student argued that both candidates are "just men," but the teacher took issue with the statement.

"He's just a man. Obama is no god," the student said.

The teacher responded: "Let me tell you something ... you will not disrespect the president of the United States in this classroom."

The teacher went on to say the two candidates are "not equal."

According to the Salisbury Post, the teacher is still employed and has not been suspended.

"The Rowan-Salisbury School System expects all students and employees to be respectful in the school environment and for all teachers to maintain their professionalism in the classroom. This incident should serve as an education for all teachers to stop and reflect on their interaction with students," the school said in a statement, published by the Post. "Due to personnel and student confidentiality, we cannot discuss the matter publicly."

The video was first posted online last week.

Lesson number 1 to all kids and fellow Americans, don't try to discuss Obama with blacks because in their minds he's the best thing ever! Now on the topic of the teacher and her lack of professionalism, I'm not saying she should be fired. But she should be spoken to. She apparently has no tolerance for other people's opinions. And she showed a complete lack of professionalism. To me she sounds very immature and uneducated. Kids deserve better than that in the classroom.

Of course we all know Romney is going to destroy Obama in the election in November. So I would advise the kids in her classroom to wait for that to happen. Then you can really mess with her.lol

Nearly 200 pages of documents released in Trayvon Martin shooting case


ORLANDO, Fla. – Trayvon Martin was shot through the heart at close range. George Zimmerman had a broken nose, bruises and bloody cuts on the back of his head.

The lead investigator in the case wanted to charge Zimmerman with manslaughter in the weeks after the shooting but was overruled.

These are among the details revealed in nearly 200 pages of documents, photos and audio recordings released Thursday in a case that's riveted the nation. Yet it's still unclear what exactly happened and whether it was racially motivated.

The evidence supports Zimmerman's contention that he was being beat up when he fired the fatal shot. At the same time, it bolsters the argument of Martin's parents that Zimmerman was profiling Martin and that the whole confrontation could have been avoided if not for Zimmerman's actions.

Zimmerman probably was profiling. If I saw a suspicious person with a hoody on walking around my neck of the woods I would think they may be a possible thief. And the fact that Zimmerman was attacked shows that he was correct in his assumption that Martin was up to no good.

I do agree that Zimmerman made a bad choice in following Martin, if that is indeed what actually happened. If I thought someone was up to no good, I would monitor them from a distance so they didn't see me and notify police.

I'm not surprised one bit that Trayvon had weed in his system. It just goes to show he is the clear criminal in all of this.

OBAMA CITIZEN-DETENTION PLAN IN TROUBLE

A district-court judge has suspended enforcement of a law that could strip U.S. citizens of their civil rights and allow indefinite detention of individuals President Obama believes to be in support of terror.

The Obama administration has refused to ensure that the First Amendment rights of authors and writers who express contrary positions or report on terror group activities are protected under his new National Defense Authorization Act.

Targeted in the stunning ruling from U.S. District Judge Katherine B. Forrest of New York was Paragraph 1021 of the NDAA, which Obama signed into law last Dec. 31. The vague provision appears to allow for the suspension of civil rights for, and indefinite detention of, those individuals targeted by the president as being in support of terror.

Virginia already has passed a law that states it will not cooperate with such detentions, and several local jurisdictions have done the same. Arizona, Rhode Island, Maryland, Oklahoma, Tennessee and Washington also have reviewed such plans.

The case was before Forrest on a request for a temporary restraining order. The case was brought on behalf of Christopher Hedges, Daniel Ellsberg, Jennifer Bolen, Noam Chomsky, Alex O’Brien, Kai Warg All, Brigitta Jonsottir and the group U.S. Day of Rage. Many of the plaintiffs are authors or reporters who stated that the threat of indefinite detention by the U.S. military already had altered their activities.

Constitutional expert Herb Titus filed a friend-of-the-court brief on behalf of the sponsor of the Virginia law, Delegate Bob Marshall, and others.

Titus, an attorney with William J. Olson, P.C., told WND that the judge’s decision to grant a preliminary injunction halting enforcement of paragraph 1021 “affirms the constitutional position taken by Delegate Marshall is correct.”

The impact is that “the statute does not have sufficient constitutional guidelines to govern the discretion of the president in making a decision whether to hold someone in indefinite military detention,” Titus said.

The judge noted that the law doesn’t have a requirement that there be any knowledge that an act is prohibited before a detention, he said. The judge also said the law is vague, and she appeared to be disturbed that the administration lawyers refused to answer her questions.

The opinion underscores “the arrogance of the current regime, in that they will not answer questions that they ought to answer to a judge because they don’t think they have to,” Titus said.

The judge explained that the plaintiffs alleged paragraph 1021 is “constitutionally infirm, violating both their free speech and associational rights guaranteed by the 1st Amendment as well due process rights guaranteed by the 5th Amendment.”

She noted the government “did not call any witnesses, submit any documentary evidence or file any declarations.”

“It must be said that it would have been a rather simple matter for the government to have stated that as to these plaintiffs and the conduct as to which they would testify, that [paragraph] 1021 did not and would not apply, if indeed it did or would not,” she wrote.

Instead, the administration only responded with, “I’m not authorized to make specific representations regarding specific people.”

“The court’s attempt to avoid having to deal with the constitutional aspects of the challenge was by providing the government with prompt notice in the form of declarations and depositions of the … conduct in which plaintiffs are involved and which they claim places them in fear of military detention,” she wrote.

“To put it bluntly, to eliminate these plaintiffs’ standing simply by representing that their conduct does not fall within the scope of 1021 would have been simple. The government chose not to do so – thereby ensuring standing and requiring this court to reach the merits of the instant motion.

“Plaintiffs have stated a more than plausible claim that the statute inappropriately encroaches on their rights under the 1st Amendment,” she wrote.

Forrest found that the plaintiffs had a reasonable fear of detention based on the language of the statute. She ordered the provision not to be enforced until further proceedings in her court or “remedial” action by Congress that would restore those protections.

During a hearing, Hedges, a longtime international reporter, testified that in connection with his reporting he interviewed members of Hamas, met with leadership and even stayed in their homes.

The brief was on behalf of Marshall and other individuals and organizations including the United States Justice Foundation, Downsize DC Foundation, Institute on the Constitution, Gun Owners of America, Western Center for Journalism, the Tenth Amendment Center and Pastor Chuck Baldwin.

“The government was given a number of opportunities at the hearing and in its briefs to state unambiguously that the type of expressive and associational activities engaged in by plaintiffs – or others – are not within [paragraph] 1021. It did not. This court therefore must credit the chilling impact on 1st Amendment rights as reasonable – and real,” Forrest said.

Marshall’s HB1160 passed the Virginia House of Delegates by a vote of 87-7 and the Virginia Senate 36-1. Since the vote was on changes recommended by Gov. Bob McDonnell, it was scheduled to take effect without further vote.

Marshall then wrote leaders in state legislatures around the country suggesting similar votes in their states.

Marshall’s letter noted Virginia was the first state in the nation to refuse cooperation “with federal authorities who, acting under the authority of section 1021 of the National Defense Authorization Act of 2012 (NDAA), could arrest and detain American citizens suspected of aiding terrorists without probable cause, without the right to know the charges against them, and without the procedural rights guaranteed by the Bill of Rights. Our new law goes into effect on July 1, 2012.”

He told lawmakers, “While we would hope that the U.S. Senate and U.S. House of Representatives would be vigilant to protect the constitutional rights of American citizens, even when addressing the problem of international terrorism, those efforts in Congress failed at the end of last year, and President Obama signed NDAA into law on December 31, 2011.”

Endorsing Marshall’s plan was the Japanese American Citizens League, which cited the detention of tens of thousands of Japanese Americans during World War II on no authorization other than the president’s signature.

Titus said in adopting the law, McDonnell “would fulfill the historic role of the states as being guardians of the people from usurpations of authority from the central government.”

Breitbart News has obtained a promotional booklet produced in 1991 by Barack Obama's then-literary agency, Acton & Dystel, which touts Obama as "born in Kenya and raised in Indonesia and Hawaii."

The booklet, which was distributed to "business colleagues" in the publishing industry, includes a brief biography of Obama among the biographies of eighty-nine other authors represented by Acton & Dystel.

It also promotes Obama's anticipated first book, Journeys in Black and White--which Obama abandoned, later publishing Dreams from My Father instead.


Barack Obama, the first African-American president of the Harvard Law Review, was born in Kenya and raised in Indonesia and Hawaii. The son of an American anthropologist and a Kenyan finance minister, he attended Columbia University and worked as a financial journalist and editor for Business International Corporation. He served as project coordinator in Harlem for the New York Public Interest Research Group, and was Executive Director of the Developing Communities Project in Chicago’s South Side. His commitment to social and racial issues will be evident in his first book, Journeys in Black and White.

The booklet, which is thirty-six pages long, is printed in blue ink (and, on the cover, silver/grey ink), using offset lithography. It purports to celebrate the fifteenth anniversary of Acton & Dystel, which was founded in 1976.

Jay Acton no longer represents Obama. However, Jane Dystel still lists Obama as a client on her agency's website.

According to the booklet itself, the text was edited by Miriam Goderich, who has since become Dystel's partner at Dystel & Goderich, an agency founded in 1994. Breitbart News attempted to reach Goderich by telephone several times over several days. Her calls are screened by an automated service that requires callers to state their name and company, which we did. She never answered.

The design of the booklet was undertaken by Richard Bellsey, who has since closed his business. Bellsey, reached by telephone, could not recall the exact details of the booklet, but told Breitbart News that it "sounds like one of our jobs, like I did for [Acton & Dystel] twenty years ago or more."


The parade of authors alongside Obama in the booklet includes politicians, such as former Speaker of the House Tip O’Neill; sports legends, such as Joe Montana and Kareem Abdul-Jabbar; and numerous Hollywood celebrities.

The reverse side of the page that features Barack Obama includes former Green Party presidential candidate Ralph Nader and early-1990s "boy band" pop sensation New Kids On the Block.



Acton, who spoke to Breitbart News by telephone, confirmed precise details of the booklet and said that it cost the agency tens of thousands of dollars to produce.

He indicated that while "almost nobody" wrote his or her own biography, the non-athletes in the booklet, whom "the agents deal[t] with on a daily basis," were "probably" approached to approve the text as presented.

Dystel did not respond to numerous requests for comment, via email and telephone. Her assistant told Breitbart News that Dystel "does not answer questions about Obama."

The errant Obama biography in the Acton & Dystel booklet does not contradict the authenticity of Obama's birth certificate. Moreover, several contemporaneous accounts of Obama’s background describe Obama as having been born in Hawaii.

The biography does, however, fit a pattern in which Obama--or the people representing and supporting him--manipulate his public persona.

David Maraniss's forthcoming biography of Obama has reportedly confirmed, for example, that a girlfriend Obama described in Dreams from My Father was, in fact, an amalgam of several separate individuals.

In addition, Obama and his handlers have a history of redefining his identity when expedient. In March 2008, for example, he famously declared: "I can no more disown [Jeremiah Wright] than I can disown the black community. I can no more disown him than I can my white grandmother."

Several weeks later, Obama left Wright's church--and, according to Edward Klein's new biography, The Amateur: Barack Obama in the White House, allegedly attempted to persuade Wright not to "do any more public speaking until after the November [2008] election" (51).

Obama has been known frequently to fictionalize aspects of his own life. During his 2008 campaign, for instance, Obama claimed that his dying mother had fought with insurance companies over coverage for her cancer treatments.

That turned out to be untrue, but Obama has repeated the story--which even the Washington Post called "misleading"--in a campaign video for the 2012 election.

The Acton & Dystel biography could also reflect how Obama was seen by his associates, or transitions in his own identity. He is said, for instance, to have cultivated an "international" identity until well into his adulthood, according to Maraniss.

Regardless of the reason for Obama's odd biography, the Acton & Dystel booklet raises new questions as part of ongoing efforts to understand Barack Obama--who, despite four years in office remains a mystery to many Americans, thanks to the mainstream media.

IRAN BOASTS U.S. HAS ABANDONED ISRAEL


Iranian outlets have been claiming recently the United States has been forced to bow before Iran on its nuclear program, demonstrating the West’s abandonment of Israel and paving the way for the Islamic regime to annihilate the Jewish state.

While restating that Iran will demand ever more in the upcoming second round of talks with the 5+1 nations to be held this month in Baghdad, the Iranian media are now boasting that Israel has been abandoned by its allies and is in a dire bind.

One such editorial, published last week by Iran’s Keyhan newspaper, which is directly under the supervision of Iran’s supreme leader, Ayatollah Ali Khamenei, stated, “It can be said that within the last 60 years, this is the first time that the Zionist regime, since its illegal inception, has had to endure rejection by the West over its vision and interest in the region.”

The editorial, written by Sadollah Zarei, a columnist for the hard-line paper, said that within the last three months, Israeli officials, after reports that America is on the verge of accepting the Iranian nuclear program, have made several trips to Washington, where on one trip they met for 10 days with U.S. officials to try to change President Obama’s decision to accept Iran’s nuclear program. They were unsuccessful.

“The ramifications of [Israeli Prime Minister Benjamin] Netanyahu’s defeat in the face of Obama’s policies have been a breakdown in Israel’s usurper regime, where now many within its own government have spoken against its own prime minister, claiming Iran is a rational regime and not after the bomb,” Zarei wrote.

While Israel’s government is in disarray internally, the editorial said, the West is forced to watch Iran’s victory in nuclear negotiations.

“The West, which in the first (5+1) Istanbul talks would not recognize Iran’s nuclear program even if the 20 percent enriched material was sent out of the country, now before stepping into the Baghdad meeting has accepted Iran’s nuclear program without even getting an assurance on the 20 percent enrichment process,” Zarei said. “All of this is taking place in front of the horrified eyes of the Zionist regime.”

The 5+1 nations, which are the five permanent Security Council nations plus Germany, have broached the subject of allowing Iran to enrich uranium to the 5 percent level for peaceful purposes. Enriching to the 20 percent level is an important step to nuclear weaponization, which Iran is pushing for as part of its stated goal of obliterating Israel.

The question now is why the West has changed its policies toward Iran, the editorial said. It could have continued with the same old policies of confrontation.

The answer, the editorial said, is that “in the last year, two important events have taken place. One has been the Islamic Awakening (the Arab Spring) in the region, which is based on the ideology of the Islamic Republic of Iran and has the West quite worried and concerned; the other is the events in Egypt, which, despite all the analysis by the West, have turned into an Islamic movement with Sharia laws. These two events have forced the West to rethink its approach toward Iran.”

As a result, Israel is backed into a corner, alone without its allies, the editorial said.

Zarei concluded that Israel has been weakened drastically with what is happening in Egypt, which has collapsed part of Israel’s regional security.

“With diminishing support for Israel and with the (upcoming) collapse of the monarchy in Saudi Arabia,” Zarei claims, “there won’t be any obstacles left facing Iran with its policy of annihilation of Israel.”

Ayatollah Mesbah Yazdi, one of the most influential clerics in the Islamic regime and possibly the next supreme leader, has stated that it is the duty of Muslims to destroy the “Zionist regime and its arrogant supporters.”

Yazdi had decreed in 2006 that in case of war between Muslims and “infidels,” Muslims can take the “infidels” as slaves until they become Muslims and then send them back to their countries.

In a new decree, Yazdi said, “When protecting Islam and the Muslim (community), martyrdom operation not only is allowed, but it even is an obligation.”

In any attack on Israel, only Israeli civilians who have opposed Israel’s “vicious crimes” should be spared, but the rest can be slaughtered, he said.

As WND has reported, the Iranian government, through a website proxy, has laid out the legal and religious justification for the destruction of Israel and the slaughter of its people.

The doctrine includes wiping out Israeli assets and Jewish people worldwide.

Calling Israel a danger to Islam, the conservative website Alef, with ties to Iran’s supreme leader, Ayatollah Ali Khamenei, said the opportunity must not be lost to remove “this corrupting material. It is a ‘jurisprudential justification’ to kill all the Jews and annihilate Israel, and in that, the Islamic government of Iran must take the helm.”

Police track leads after Utah girl allegedly comes face-to-face with home intruder


Utah police are tracking leads after an 11-year-old Salt Lake City girl allegedly came face-to-face with an gunman when she walked into her kitchen to get a snack while home alone Friday.

The girl said she saw an armed, dark-skinned man in her kitchen, who apparently came through the back door of her home, which was open, Fox 13 Now reports.

When the girl attempted to reach her cell phone to alert police, the intruder allegedly stuck his gun in her face and told her not to make the call.

The girl then bolted out of the front door of her home, police told Fox 13 Now, and ran into a neighbor’s house to call 911.

The suspect -- who the girl described as around 6-feet tall with braided hair and wearing dark sunglasses -- evaded police before they arrived at the home.

Romney defends marriage and faith in Liberty University speech


Mitt Romney doubled down on his position against same sex marriage, telling graduates at Liberty University Saturday that marriage between "one man and one woman" is an "enduring institution" that should be defended.

Coming just days after President Obama endorsed the right of gays and lesbians to marry, the comment earned Romney a standing ovation from the crowd of more than 30,000 people—the largest crowd Romney has ever addressed as a political candidate--but it was his only mention of the hot button social issue.

Instead, the presumptive Republican nominee used his commencement address at that evangelical university to emphasize the importance of faith and family—and take some slight digs at President Obama's handling of the country, though he didn't name his 2012 opponent.

"Lately, I've found myself thinking about life in four-year stretches. And let's just say that not everybody has achieved as much in these last four years as you have," Romney said. " But that's a theme for another day."

Indeed, Romney touched only fleetingly on issues that could be potentially controversial. His visit to Liberty, a Christian university founded by the late televangelist Jerry Falwell, was an overt appeal to social conservatives who have been wary about his White House bid. But his appearance had generated protests by some Liberty students, where the curriculum has described Romney's Mormon faith as a "cult."
Romney did not use his Saturday address to specifically defend his Mormon faith. But he did speak at length about the importance of faith in his own life—a riff that was clearly an attempt to discourage suspicion about his personal beliefs. He argued that people, no matter what they believe, could agree on faith and moral service to the country.

"People of different faiths, like yours and mine, sometimes wonder where we can meet in common purpose, when there are so many differences in creed and theology." Romney said. "Surely the answer is that we can meet in service, in shared moral convictions about our nation stemming from a common worldview."

He argued that faith and belief in God was more important than "trivial things"—but acknowledged that he, like others, had occasionally lost sight of that. He urged the graduates to always turn back to faith.

"What we have, what we wish we had--ambitions fulfilled, ambitions disappointed; investments won, investments lost; elections won, elections lost--these things may occupy our attention, but they do not define us. And each of them is subject to the vagaries and serendipities of life," Romney said. "Our relationship with our Maker, however, depends on none of this…The best advice I know is to give those worldly things your best but never your all, reserving the ultimate hope for the only one who can grant it."

While Romney aides insisted the former governor's remarks would not be a "policy" speech, he gave a shout out to his former rival Rick Santorum, saying that he agreed that America's greatness was defined by its "culture" and "values." And he also argued for the protection of "religious freedom," saying it's become a "matter of debate."

"It strikes me as odd that the free exercise of religious faith is sometimes treated as a problem, something America is stuck with instead of blessed with," Romney said. Ideally we'de like a Christian president but it looks like we didn't get that option this time around. But I believe Romney will do a good job as president. Obama becomes more wicked with every passing year, we really can't handle another 4 years of him. It's time to give him the boot, and give Romney a chance. Obama states that he supports gay marriage


Now Is it just me or does he sound very insincere? Far be it from me to judge anyone. But The Bible does say to judge things by their fruits. And though Obama claims to be a Christian, his actions and policies prove that he is not. Especially with Obama coming out yesterday and proclaiming his support for homosexual marriages.

Now Obama is either a liar, or is very uneducated in the beliefs of Christianity. I personally believe he simply says and does anything he can to pander to a certain crowd and to land votes.

As it stands right now, most Americans want Obama gone and that includes liberals. So he is hunting for votes. Let's hope and pray that the majority of Americans vote him out of our white-house this November. Pull your friends and family down to the polls and get them to vote for Obama's opponent.

Let's have the Americans who never vote come out of the wood works and show support for the Word of God and vote this perverse man out of office.

The Bible is clear that homosexuality is a perverse unnatural sin. And those who practice it will not inherit the Kingdom of God. Homosexuality is an activity, not an identity. And for Obama to support and advocate such an act shows that he is no where near being a Christian.

The Pentagon poo-pooed ‘Avengers’ teamup


You know all that military action that goes on in a lot of Hollywood blockbuster films? Well, the U.S. government usually likes to get involved to help filmmakers more realistically portray it.

This was not the case with "Marvel's The Avengers." The U.S. Defense Department pulled out because they deemed the film too unrealistic.

Perhaps it was the aliens. Or maybe it was the superheroes.

Well, it was actually the ambiguity of secret military law-enforcement agency S.H.I.E.L.D., portrayed in the film, that did "Avengers" in.

From a recent Wired report:
"We couldn't reconcile the unreality of this international organization and our place in it," Phil Strub, the Defense Department's Hollywood liaison, tells Danger Room. "To whom did S.H.I.E.L.D. answer? Did we work for S.H.I.E.L.D.? We hit that roadblock and decided we couldn't do anything" with the film.

(Not to deviate from the topic, but doesn't Strub have, like, the coolest job on the planet?)

One example of the U.S. military's lack of involvement in "Avengers" is the fact that a few of the military's latest stealth jets that appear in the film were actually added digitally by the studio -- they were not real jets provided by the Pentagon, Wired further reports.

The Pentagon has greenlit military involvement, providing drones and jets for films including "Iron Man," "Transformers," and "Eagle Eye." The secretary of the Navy even appears in the upcoming "Battleship," starring Rihanna and Taylor Kitsch, in theaters May 18th.
But wait.

Like "Avengers," "Battleship" also portrays an alien invasion. Isn't THAT unrealistic? (Maybe the Pentagon knows something we don't. *wink*)

U.S. MILITARY DEVELOPING SPYCHIPS FOR SOLDIERS

The U.S. military wants to plant nanosensors in soldiers to monitor health on future battlefields and immediately respond to needs, but a privacy expert warns the step is just one more down the road to computer chips for all.

“It’s never going to happen that the government at gunpoint says, ‘You’re going to have a tracking chip,’” said Katherine Albrecht, who with Liz McIntyre authored “Spychips,” a book that warns of the threat to privacy posed by Radio Frequency Identification.

“It’s always in incremental steps. If you can put a microchip in someone that doesn’t track them … everybody looks and says, ‘Come on,’” she said. “It’ll be interesting seeing where we go.”

According to a report at Mobiledia, the U.S. military’s Defense Advanced Research Projects Agency has confirmed plans to create nanosensors to monitor the health of soldiers on battlefields.

The devices also would report data to doctors. But privacy analysts have expressed concern that the implants could be used not just to monitor health but to keep track of and possibly control people.

DARPA describes the technology on which it is working as “a truly disruptive innovation,” which would diagnose, monitor vital states and “even deliver medicine into the bloodstream.”

According to LiveScience.com, “Solving the problem of sickness could have a huge impact on the number of soldiers ready to fight, because far more have historically died due to illness rather than combat.”

The report suggested that for special forces, “the practical realization of implantable nanosensors capable of monitoring multiple indicators of physiological state could be a truly disruptive innovation.”

Already being researched is the concept of nanosensors diagnosing disease.

DARPA expects to launch a second effort focused on treatment later this year.

Albrecht said the move is another step in the trip down the road of having every person implanted with a chip that might very well monitor health but also other areas of life.

Microchipping, she said, already is “par for the course” for pets in many parts of the nation, and that acceptance will make it easier to require it for people.

She said it was expected that captive audiences, such as prisoners and troops, would be the first subjected to the requirement, which would make it easier for the general populace to accept it as well.

“It’s interesting,” she said. “I’m stunned how this younger generation is OK. They don’t see the problem. … ‘Why wouldn’t everyone want to be tracked?’”

But she said Americans will have to decide to say no to incremental advances, or by the time officials finally roll out the idea of chips for all, whether they want them or not, it will be too late to decide.

“The analogy that I draw is [that of a train], and if I’m in California and I do not want to wind up in New City, every stop brings me closer,” she said. “At some point I have to get off the train.”

Albrecht also has helped develop and launch a new project called StartPage, which now is handling some 2 million search requests per day.

The benefit of the page is its privacy. The site explains that every time a person uses a typical search program such as Google, “your search data is recorded.”

“Then they store that information in a giant database,” she explains.

As a result, corporate America and the government have access to “a shocking amount of personal information about you, such as your interests, family circumstances, political leanings, medical conditions and more

WND reported previously that owners of pets have reported cancer in their animals after microchipping. The report documented how a dog developed a highly aggressive cancer right at the point where a chip was embedded.

Albrecht told the story of another dog, a 5-year-old Yorkshire terrier named Scotty that was diagnosed with cancer in Memphis, Tenn. Scotty developed a tumor between his shoulder blades, in the same location where the microchip had been implanted. The tumor the size of a small balloon – described as malignant lymphoma – was removed. Scotty’s microchip was embedded inside the tumor.

Verichip, a major manufacturer of the microchip implants, touts the technology’s capability to identify a lost pet and enable its return home, while dismissing potential health risks.

“Over the last 15 years,” stated the VeriChip website, “millions of dogs and cats have safely received an implantable microchip with limited or no reports of adverse health reactions from this life-saving product, which was recently endorsed by the USDA. These chips are a well-accepted and well-respected means of global identification for pets in the veterinary community.”

WND also reported there were warnings about a radio chip plan that would allow identification of individuals by government agents simply by walking through an assembly.

The proposal, which was supported by Janet Napolitano, the chief of the Department of Homeland Security, would embed radio chips in driver’s licenses, or “enhanced driver’s licenses.”

“Enhanced driver’s licenses give confidence that the person holding the card is the person who is supposed to be holding the card, and it’s less elaborate than REAL ID,” Napolitano said in a Washington Times report.

REAL ID was a plan for a federal identification system standardized across the nation that so alarmed governors many states have adopted formal plans to oppose it. However, a privacy advocate today told WND that the EDLs are many times worse.

WND also previously has reported on such chips when hospitals used them to identify newborns, a company desired to embed immigrants with the electronic devices, a government health event showcased them and when Wal-Mart used microchips to track customers.

Lou Buren of TWAU BLOG: My friends, we are getting closer and closer to the mark of the beast being implemented. Notice how they slowly keep adding uses for the chips? gradually getting people used to the idea? People are being prepped for the acceptance of the chip. I agree that people will never be forced at gunpoint to wear the chip. But many will gladly accept it. And there will be consequences for those who don't wear the chip.

If you want to have a house, a job, have a bank account you'll have to have the chip. Basically if you want to participate as a citizen you'll have to wear the chip. You'll have to bare the mark of the beast.

I was hoping we'd never have to deal with this in my generation or my children's. But it seems the time is upon us. And it's sad that so many non-believers and willfully blind will fall prey to this occurrence.

I guess it can't be stopped for it is written, but we can try to slow it down by not accepting it. And fighting it as long as possible.

ACLU Puts Ten Commandments on Trial

On Monday, May 7, Judge Michael Urbanski of the United States District Court for the Western District of Virginia will hold a summary judgment hearing on Doe v. School Board of Giles County. Liberty Counsel will represent the school board against the American Civil Liberties Union (ACLU), which represents the Doe plaintiffs in the suit.

ACLU of Virginia sued the Giles County School Board after the Board adopted an open forum policy, which permits the display of historical documents by private individuals or groups. A privately-sponsored historical document display consisting of eleven documents, one of which is the Ten Commandments, in equally-sized frames was posted in Narrows High School. The Foundations of American Law and Government display also includes, among other documents, the Magna Carta, Declaration of Independence and Mayflower Compact.

The Virginia Standards of Learning requires students to know about the foundational principles of civilizations, including the Hebrews, and the foundations of law and government. Secular textbooks published by Prentice Hall and McGraw-Hill trace the roots of democracy and law and specifically refer to the Ten Commandments and many of the documents posted as part of the Foundations Display.

Mat Staver will argue in federal court on Monday in defense of the Giles County School Board.

YOUTUBE PULLS PLUG ON CHRISTIAN VIDEOS

WASHINGTON – The author of a soon-to-be-released book on Christian apologetics, “The Magic Man in the Sky: Effectively Defending the Christian Faith,” is questioning the motives behind the termination of the immensely popular PPSimmons Ministry account on YouTube.

Where once one of the more popular God and Country YouTube Channels – with more than 23,000 subscribers, 530-plus videos and 21 million views – could be accessed, now a barren page is found, save for a message. The message reads: “This account has been terminated due to repeated or severe violations of our Community Guidelines and/or claims of copyright infringement.”

For Pastor Carl Gallups, one of the people behind the popular PPSimmons YouTube Ministry, seeing a channel disabled he has worked tirelessly to build and promote since 2009 was devastating.

“It was as if you have a thriving business and you came to work one day and the building was burnt down and everything you had created was gone. Instantly,” he told WND.

Gallups, whose “The Magic Man in the Sky: Effectively Defending the Christian Faith,” will be released May 15, was one of the original founders of the PPSimmons Ministry on YouTube.

Through his involvement with producing and recording more than 530 videos, Gallups was once named “Worst People in the World” by Keith Olbermann on his now-defunct MSNBC show. Videos from the PPSimmons YouTube channel were featured on CNN, “The Rachel Maddow Show” and Fox News.

The PPSimmons site was known for producing videos on biblical commentary, startling biblical revelations and, perhaps most controversially, political revelations concerning Barack Obama and his birth certificate.

The PPSimmons Ministry Channel was in excellent standing with YouTube before it was pulled last week, according to Gallups.

Of more than 530 videos released over a three-year time span, with a number of them having more than a million views, only three had come to the attention of YouTube and been “flagged” for potentially inappropriate content.

“When we first got started in 2009, we did a video on abortion that was flagged by YouTube for being too graphic,” said Gallups.

Immediately, he said, the video was pulled and PPSimmons was placed on probation for a period of time before it was completely restored to a “Good Standing” rating with YouTube.

“Since then, we haven’t had any problems with YouTube and have been grateful for having a platform to grow our ministry to the point that it became viral sensation that touched the lives of tens of thousands of people,” said Gallups.

It was only three weeks ago that PPSimmons came to the attention of YouTube again, with the posting of George Zimmerman’s 911 call.

“The media wasn’t doing their job in covering the Trayvon Martin-George Zimmerman affair,” said Gallups, who before becoming a minister spent 10 years in law enforcement. “Truth has since vindicated Zimmerman after the initial media onslaught.”

The recording was in the headlines because NBC famously quote Zimmerman saying, “This guy looks like he’s up to no good. He looks black.”

But NBC had edited out critical parts of the conversation. In reality, Zimmerman said, “This guy looks like he’s up to no good. Or he’s on drugs or something. It’s raining and he’s just walking around, looking about.”

The operator then asked: “OK, and this guy – is he black, white or Hispanic?

Zimmerman said, “He looks black.”

Gallups explained that the posting was the complete four-minute version of the call.

“That same video is all over YouTube, but they flagged the video,” he said. “We appealed the decision, and in a few days YouTube responded and admitted that they were wrong, and the video was restored, and so was our Good Standing status.”

The temporary victory was short-lived, as Gallups tried to log on to the PPSimmons account a few days later only to find the “terminated” notice.

“Though YouTube restored the Zimmerman 911 call video, we received notice that the channel was terminated because another video was flagged, and we had received too many warnings to continue to allow our channel to operate,” he said.

The video that YouTube flagged and used to closed down the PPSimmons channel was titled “A Call to Prayer” and remains on Gallups’ site.

“It was a simple video, in my voice, urging our subscribers to pray for YouTube users who were asking for our prayers and because of spiritual battles that they were experiencing in their life,” said Gallups.

It calls for prayer for those who are caught in the “demonic grip” of homosexuality, masturbation and pot smoking, “and they don’t even know it.”

It explains drug and sexual addictions are “not the way of a true believer.”

“We are not here to help people feel good about their sins,” the video explains.

Gallups said one can see videos on YouTube that attack Christianity, demonize and bully proponents of traditional marriage and call Muslims to prayer, “but to make a video calling for Christians to pray is ostensibly grounds for having your channel terminated.”

“To make matters worse, the termination of the YouTube channel occurred two weeks prior to the release of my book, ‘The Magic Man in the Sky,’ and at the same time I was doing interviews across the nation on talk radio concerning the Sheriff Joe Arpaio investigation into President Obama’s birth certificate ordeal,” said Gallups.

“This is unfairly impugning the character of anyone who is involved with PPSimmons and, worse, we have no chance to appeal this decision nor any reason to suspect why it was pulled,” said Gallups.

WND sent an email request for comment to YouTube but got not response.

In the meantime, Gallups has started the Carl Gallups YouTube Channel and is uploading many of the videos that were featured on the terminated PPSimmons channel.

“If this channel gets terminated, we’ll have a better idea of why,” said Gallups.

Lou Buren of TWAU BLOG: How sad it is that youTube saw fit to delete this preachers video work. I know the Christian haters out there love to flag Christian video's left and right for youtube review. Just to make problems for the person uploading the videos. I like how the preacher stated he wasn't looking to make anyone feel good about their sin. Because that's what many secularized preachers do today.

If you truly want to help people with their sin, tell them the true consequences and that you must repent from your sins! Walk away from sin! It's hard, I know I have struggled with sin for a very long time. But it can be overcome with the help of Jesus. If YouTube is going to start deleting Christian content I would suggest to video uploaders to switch to GodTube.

If all of the Christian video uploaders went to Godtube it would certainly hurt YouTube's profits.

Seattle mayor issues emergency order after May Day mayhem


As activists across the U.S. joined in worldwide May Day protests Tuesday, Seattle protestors dressed in black clothing smashed windows of retail stores and banks and spray-painted parked cars.

Seattle Mayor Mike McGinn says he's making an emergency declaration allowing police to confiscate items that can be used as weapons following violent May Day protests that left storefronts and car windows shattered.

Police said officers made at least three arrests after hundreds of people marched through downtown Tuesday afternoon. A 23-year-old man was arrested for vandalism and a 19-year-old man with a knife was also arrested.

Protestors dressed in black clothing smashed windows of retail stores and banks, and spray-painted parked cars, reported Q13 FOX News. NikeTown, American Apparel, HSBC, and Wells Fargo were among the businesses protesters vandalized.

McGinn said protesters were using items that looked like flagpoles as weapons. He said his order would enable police to take those items away from people before they are used to cause damage. McGinn said his action would help protect public safety as protests continued into Tuesday evening.

As many as 2,000 people are expected to participate in the "May Day March for Immigrant and Workers Rights," which will start at Judkins Park at 5 p.m., and police said there will be a rally in front of the Federal Building at Second Avenue.

Activists across the U.S. joined in worldwide May Day protests Tuesday, with anti-Wall Street demonstrators leading the way in some cities as they tried to recapture the enthusiasm that propelled their movement last fall.

While some protesters clashed with police, the melees were far less violent than ones that erupted last fall when the movement was at its peak. Marches and strikes led to a handful of arrests but no major disruptions.

Many of the rallies, which drew activists pushing a variety of causes, also did not have the same drawing power that gatherings had last year for the Occupy movement or a half-dozen years ago for May Day rallies for immigration reform.

Across the world on Tuesday, protests drew tens of thousands of demonstrators into the streets from the Philippines to Spain. They demanded everything from wage increases to an end to cuts in education, health care and other austerity measures.

The U.S. protests were the most visible organizing effort by anti-Wall Street groups since the movement's encampments were dismantled last fall.

Lou Buren of TWAU BLOG: Look at the photo above and ask yourself, what do I see? Do you see protesters? I don't. I see terrorists destroying property. Look at the way they are dressed. They planned from the get go to behave like this. What I can't understand is why the media is calling them protesters. I have no problem with people PEACEFULLY protesting. But when you start destroying property and fighting with police that's when people need to do some serious prison time.

I would advice mayors and leaders to nip this in the bud quickly and deal with these morons before the situation really gets out of hand. You can't stop them from protesting, but when they act like this and they have been. you most certainly can act, and act harshly.
